Discipline

The following members or registrants have been found to be in breach of Swim Ontario polices and procedures or the Swim Ontario Comprehensive Code of Conduct.

  • Mischa Sommerville – was to found to be in breach of Section 7 (d), Section 7 (j), Section 12 (h), Section 12 (o), and Section 12 (r) of the Swim Ontario Comprehensive Code of Conduct and Ethics (2015-2023). Mischa Sommerville was suspended from all Swim Ontario related activities for the period June 28, 2019 to August 31, 2021. Mr. Sommerville was subsequently found to be permanently ineligible to apply for membership with the Canadian Swim Coaches Association which prohibits him from coaching with Swim Ontario.
  • Matthew Bell - Impact of Sanctions applied - On November 7, 2017, Swimming Canada suspended Mr. Matthew Bell for life from participating in any Swimming Canada activities.
  • Tristan Li - was found to be in breach of Sections 7(c)(v), 7(c)(vi), 7(f), 12(k), 12(o), 12(r), and 12(u) of the Swim Ontario Comprehensive Code of Conduct and Ethics (2015-2023). Tristan Li is suspended for life from all Swim Ontario related activities.
  • Windsor Essex Swim Team (WEST) was found to have breached sections 6(A), (M), (O) of theSwim Ontario Code of Conduct. In the decision, it was found that WEST permitted two of its coaches, who were not listed on the official coach compliance list, to be on deck at sanctioned competitions without applicable certification and supervision. A fine of up to $2,900.00 was imposed.
  • Greg Kozell (coach) was found to have breached the Swim Ontario Comprehensive Code of Conduct and Ethics for All Participants, including Parents/Guardians, dated 2023 under sections 4(C),(K) and 9(S) and is subject to a period of ineligibility until 11:59pm, November 10, 2026.

    Coach Kozell is also ineligible to participate in Swim Ontario special programming events, including but not limited to, events and programs organized and administered directly by Swim Ontario outside its regular provincial competition calendar, including camps, clinics, development initiatives, leadership activities, and designated special events, as well as Swim Ontario funding opportunities, until August 31, 2028.
  • Goulbourn Sea Hawks (GSH) was found to have breached sections 4(C),(K) and 6(A),(F),(P) of the Swim Ontario Comprehensive Code of Conduct and Ethics for All Participants, including Parents/Guardians, dated 2023. A fine of $6,000.00 was imposed.
